Just hours after a news conference in which San Bernardino police described a fatal armed robbery at drive-thru dairy, a third person was arrested in connection with the crime.

The arrest of Jason Allen, 25, was announced in a San Bernardino Police Department news release Tuesday.

He was taken into custody about 2:30 p.m. Monday, soon after a news conference where police described the killing of 36-year-old Mitesh Patel at the Bossey Drive-In Dairy, which he co-owned.

Two others — Desmond Stevenson, 25, and Robert Green, 23 — were arrested over the weekend in connection with the Friday, Jan. 29, armed robbery at the dairy.

The robbery occurred about 7:45 p.m. at the dairy at 1611 N. E. St., a block from San Bernardino High School. Two masked, armed men entered the dairy, demanded money, and then one man fatally shot Patel.

Stevenson, who police said had an extensive criminal record, was suspected of firing a shotgun at Patel during the robbery. Green was allegedly armed with a handgun.

Allen was the getaway driver and provided the handgun, according to Tuesday’s news release. The gun believed to have been used in the robbery was found at his home, according to police.

All three of the men have gang ties, police said.

Allen was being held on suspicion of murder, robbery, being a felon in possession of a firearm, and street terrorism.

Patel had immigrated from India in 2003 and leaves behind a wife and 3-year-old daughter, his cousin said.

A GoFundMe page set up to create a college fund for the little girl had raised more than $10,000 in two days, as of midday Tuesday.
